Terms of Service for CostMate, an estimating tool for NZ building and trade businesses. Estimates are indicative only, not professional advice.
Last updated: 23 October 2026
These Terms of Service ("Terms") are a legal agreement between COSTMATE LIMITED ("CostMate", "we", "us", "our"), a company registered in New Zealand (Company number 9426990, NZBN 9429053650153), and the person or business that uses the CostMate website and application (the "Service"). By ticking to accept these Terms at sign-up, or by creating an account or using the Service, you ("you") agree to these Terms and to our Privacy Policy.
CostMate is supplied for business purposes only and is marketed to building and trade businesses. When you create an account you confirm that you are acquiring and using the Service in trade for business purposes. On that basis, you agree that the guarantees in the Consumer Guarantees Act 1993 do not apply, and that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, in each case to the maximum extent permitted by law. You agree that it is fair and reasonable for these provisions not to apply, given the Service is supplied to you in trade. If you are not acquiring the Service in trade, you must not use it.
CostMate is a software tool that helps building and trade professionals prepare estimates and quotes and review scope. It produces indicative figures based on the information you enter and on reference data and rule sets.
You are responsible for every quote you produce. CostMate's outputs are estimates only. Before relying on any output, providing a quote to a client, entering into a contract, or ordering materials, you must independently verify all quantities, pricing, scope, materials, allowances, and Building Code and regulatory compliance.
We do not warrant that any figure, quantity, price, allowance or compliance item produced by the Service is accurate, current or complete. Nothing in the Service, including any AI-generated summary or assistant guidance, is professional, legal, engineering, quantity-surveying or building-certification advice, and it does not replace the judgement of a Licensed Building Practitioner, quantity surveyor or other qualified professional. Responsibility for the final quote, for the work, and for all professional and regulatory obligations, remains entirely yours.
Any quote, estimate or document you create and send is an arrangement between you and your client. CostMate is not a party to it and has no liability to your clients. You are responsible for all of your dealings with your clients, including the accuracy of what you send them.
Your crew, subcontractors and clients. CostMate is a tool you use to run your business. When you add people to CostMate (crew, subcontractors, office staff, clients or visitors) or use it to record, schedule or contact them, you are responsible for telling them what you collect and why, for getting any agreement the law requires, and for how you use what they give you. That includes hours and start and finish times, planned days, site sign-ons, photos of their property, and emails CostMate sends in your name. We handle their information as our Privacy Policy describes, and we act on your instructions when we do. If you stop using CostMate, you can download your records first.
You must provide accurate information, keep your login credentials secure, and you are responsible for all activity under your account. Tell us promptly if you become aware of any unauthorised use.
You retain ownership of the information and content you enter ("Your Content"). You grant us a licence to host, process and display Your Content as needed to provide the Service. You warrant that you have the right to provide all information you enter, including any personal information about your clients, and that doing so does not breach any law or any third party's rights. How we handle personal information is set out in our Privacy Policy.
Paid plans are billed in advance through our payment provider (Stripe) at the price shown when you subscribe (currently from NZD $49 per month).
CostMate is not currently registered for GST, so no GST is added to the subscription fee. If we become registered for GST in future, the price shown will be treated as inclusive of GST and we will make this clear at the time.
Subscriptions renew automatically until cancelled. You can cancel at any time, with cancellation effective at the end of your current billing period. Except as set out in clause 15 or as required by law, fees are non-refundable. While you stay subscribed to a paid plan, we will not increase the price you pay for it, and we will not move a feature you use on that plan into a more expensive plan. We may set different prices or plans for new subscribers. If you cancel and later subscribe again, the price at that time applies.
Refer a mate. If a builder you refer through your Refer a mate link signs up and pays their first month, you each get one month of your own plan as account credit, taken off your next bill. The credit has no cash value and cannot be transferred. It applies once per new business, up to 12 a year for each referrer, and never to your own or a linked account. We may withhold or withdraw it if the offer is misused.
You must not: misuse the Service or use it unlawfully; attempt to access it or its data without authorisation; copy, resell, sublicense or commercially exploit it; reverse engineer, scrape or extract its data or rule sets except to the extent the law does not allow this to be prohibited; or upload malicious, infringing or unlawful content.
We (and our licensors) own all rights in the Service, including its software, design, rule sets, calculation logic and content. We grant you a limited, non-exclusive, non-transferable licence to use the Service while your account is in good standing. These Terms do not transfer any of our intellectual property to you.
We aim to keep the Service available, but we provide it "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free, and we may modify, suspend or discontinue features.
We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control. This includes failures of the third-party providers we rely on (such as hosting, database, payment, email or AI providers), internet or infrastructure outages, natural events, or other force-majeure events.
To the maximum extent permitted by law:
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including liability for fraud, or for death or personal injury caused by our negligence.
You indemnify us against any claim, loss, liability or cost (including reasonable legal costs) arising from your use of the Service, the quotes or documents you produce, Your Content, your dealings with your clients, or your breach of these Terms or of any law, except to the extent the claim, loss, liability or cost is caused by our own breach of these Terms, our negligence, or our wilful misconduct.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, or use the Service in a way that risks harm to others or to us.
If we terminate your account, or permanently discontinue the Service, without cause (and where you are not in breach), we will refund any prepaid fees covering the period after termination on a pro-rata basis.
For 30 days after your account ends, you may export Your Content in a common format. After that, we may delete it in line with our Privacy Policy.
Provisions that by their nature should survive termination (including clauses 4, 5, 7, 10, 13 and 14) will continue to apply.
We may update these Terms from time to time. For material changes, we will give you at least 30 days' advance notice (through the Service or by email) and you may cancel before the change takes effect. If you continue using the Service after the change takes effect, you accept the updated Terms. We may make minor or operational changes at any time.
We will send you transactional messages needed to operate the Service (such as quotes, receipts and account notices). We may also send you product and marketing emails about CostMate; you can opt out of these at any time using the unsubscribe link, without affecting transactional messages. We comply with the Unsolicited Electronic Messages Act 2007.
These Terms, together with the Privacy Policy, are the entire agreement between us about the Service and replace any prior representations or agreements. If any provision is found to be unenforceable, the remaining provisions continue in force. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours (for example, on a sale or restructure of our business). A failure to enforce a provision is not a waiver of it.
These Terms are governed by the laws of New Zealand. If a dispute arises, we both agree to first try in good faith to resolve it by discussion. You submit to the non-exclusive jurisdiction of the New Zealand courts.
